Amendments to original whistle blowing legislation commenced in practice in January 2023, including that employers used to be able to defend a 'penalisation claim' by using defense that 'it is a grievance, not a protected disclosure'. Employers can still do that, but if relying on this defence, the burden of proof is on the employer.
