Irish rail ordered to pay compensation for ageist discrimination
What is really unusual is that the adjudicator specifies how compensation is to calculated and paid to him. But does not specify the exact amount.
I myself feel that the exact amount should have been worked out and then specified by the Adjudicator. Otherwise, it could lead to further disputes.
That's the way this works though. I can think what I like. You can think what you like. It is the Adjudicator though that makes the decision.
The adjudicator ordered for him to be paid equivalent of a statutory redundancy payment. He wasn't made redundant. He was discriminated against on grounds of age.
Was some element of 'redundancy' apparently involved in his case. The case he brought though was not 'redundancy'.
Adjudicators are humans that make 'human decisions'. Whether you win or lose, you won't always agree with everything they do.
