Dismissed or not ? I did not resign !
The X case, if you want to call it that, has raised a ;lot of eyebrows over the amount of the award, half a million.
The award is based on the salary you were on and loss of earnings. In this case, it was a high level employee on a large salary. You can not just dismiss someone and then pretend or say that the person has resigned.
For a unfair dismissal case to succeed though, you do have to have actually been dismissed. Which is much more common than people realise. Am I actually dismissed ?
Not every case succeeds. One recently for a foreign national failed, in that he was not actually dismissed. For him there appears to have been a lot of confusion and misinformation.
